Waiver Flow C: Sports Recovery Service-Specific Consent, Agreement, & Waiver

SECTION 1: FLOW C SPORTS RECOVERY SERVICES OVERVIEW, CONSENT & AGREEMENT 

1.1 WHAT YOU'RE ENROLLING IN 

Flow C Sports Recovery Services include: 

• Compression Boot Therapy (Squeeze Sessions): Pneumatic compression (air pressure) applied to legs and/or hips to enhance venous return and reduce muscle soreness. Up to 30 minutes per session. You can choose your intensity level (1-7) and adjust at any time. 

• Infrared Sauna Therapy (Heat Sessions): Dry heat sauna using infrared technology to support recovery, relaxation, and general wellness. Up to 30 minutes per session. Private access to infrared sauna plus all stretch and yoga equipment in our Recovery Room. 

Services will be customized to your body, goals, and current capacity. 

1.2 HEALTH SCREENING & FITNESS 

☐ I have reviewed contraindications at Compression Guide and Sauna Guide. I confirm I have no contraindications; or I have obtained and will provide medical clearance from a licensed medical provider if I have a contraindication listed. 

☐ I am physically and mentally capable of participating. I have disclosed all relevant health conditions, medications, allergies, and concerns to my provider. I am not pregnant and not under the influence of alcohol or drugs. 

☐ I will hydrate adequately before and after sessions and immediately inform my provider of any pain, discomfort, or concern during a session. 

1.3 BENEFITS, RISKS & CONSENT 

Sports Recovery Services are wellness support only—NOT medical diagnosis or treatment. You may experience muscle soreness reduction, relaxation, enhanced circulation, improved recovery, or improved sleep. Results vary and cannot be guaranteed. 

Potential risks include temporary skin irritation, dizziness, dehydration, or fatigue. You are NOT required to "push through" discomfort. If you feel dizzy, uncomfortable, or unbearably hot, exit slowly and notify staff immediately. 

☐ I acknowledge and understand the potential benefits and risks of Sports Recovery Services. 

☐ I voluntarily consent to receive Sports Recovery Services from The Body Intuitive. 

☐ I accept full responsibility for any risk, injuries, or damages, known or unknown, from participation in these services. 

1.3 SCHEDULING & BILLING POLICIES 

1.3.1 Service Expiration 

• Single-session services expire 30 days after purchase 

• Packages of 4 sessions expire after 90 days 

• Expired services are forfeited and non-refundable 

• Individual sessions can be rescheduled up to 3 times before considered forfeited 

1.3.2 Scheduling & Cancellation 

• Sessions are scheduled first-come, first-served 

• 24 hours' notice is required to reschedule or cancel 

• The full session amount is charged for cancellations within 24 hours 

• No refunds or session credits are provided for late cancellations 

• For package clients, late cancellations are decremented from your package total 

• Your package expiration date will not be extended for cancellations or no-shows within 24 hours 

1.3.3 Your Responsibility 

• Schedule all appointments before your service expiration date 

• It is your responsibility to reschedule before your package expires

1.4 EMERGENCY PROTOCOLS 

The Body Intuitive is NOT an emergency or crisis service. If you experience an acute medical emergency or need emergency care: 

• Contact your primary care physician or insurance plan 

• Visit your local urgent care or hospital 

• Dial 911 for emergencies 

The Body Intuitive does not provide 24/7 availability and cannot guarantee immediate response outside of scheduled sessions.

SECTION 2: COMMUNICATIONS & DATA PRIVACY 

2.1 COMMUNICATIONS CONSENT 

1. ☐ Consent to Communications: I consent to receive emails, text messages, and/or phone calls from The Body Intuitive for scheduling, transactional information, and general support. Message data rates may apply. I can reply STOP to SMS messages from The Body Intuitive to opt out at any time; and I can unsubscribe from all emails except transaction-related notifications at any time..

1. Changes to Communication Preferences and Consents. You may change your communication consent or practices by providing notice to the practitioner, either verbally or in writing, at any time. 

2.2 TESTIMONIAL & MARKETING CONSENT 

NOTE TO CLIENT: Testimonials and marketing use are completely optional and separate from your services agreement. Declining will NOT affect your care, pricing, scheduling priority, or access to services. 

Select ONE option below to indicate your preference for TESTIMONIALS: 

☐ OPTION A — Full Identification: I consent to The Body Intuitive using my testimonial with my full name and/or social media handle, image/likeness, and/or occupation in marketing/promotional use in any media or format (print, digital, social, video, audio, website). 

☐ OPTION B — Limited Identification: I consent to The Body Intuitive using my testimonial with only my first name and/or image/likeness, without additional identifying information (no last name, no full handle, no contact details). Marketing use may occur in any media or format. 

☐ OPTION C — Anonymous Use: I consent to The Body Intuitive using my testimonial anonymously, with NO personally identifying information included. Marketing use may occur in any media or format. 

☐ OPTION D — No Marketing Use: I do NOT consent to my testimonial, image/likeness, or statements being used for marketing/promotional use. My feedback may be used internally only for service improvement. 

You may revoke your testimonial/marketing consent at any time by emailing support@thebodyintuitive.com. Revocation will apply prospectively. Previously published materials may not require removal unless otherwise required by law. 

2.3 HIPAA POLICY 

☐ HIPAA Policy Receipt Acknowledgment: I acknowledge receipt of the HIPAA Notice of Privacy Practices available at https://www.thebodyintuitive.com/hipaa. I understand my data is managed according to the Master Service Agreement Section 3 (available at https://www.thebodyintuitive.com/masteragreement). 

SECTION 3: ACKNOWLEDGEMENTS, LEGAL DISCLAIMERS & LIABILITY WAIVER 

3.1 NO GUARANTEE OF RESULTS 

The Body Intuitive makes no warranty or guarantee regarding any specific results, outcomes, or benefits. Results vary widely and are not guaranteed. You may experience some, all, or none of the potential benefits described. 

3.2 MEDICAL DISCLAIMERS 

These services are NOT medical advice, medical treatment, diagnosis, or psychotherapy. Compression therapy and infrared sauna services are NOT substitutes for medical care, mental health treatment, or other licensed healthcare services. If experiencing a medical or mental health emergency, contact 911, your physician, or a mental health crisis line immediately. 

3.3 WAIVER & RELEASE OF LIABILITY 

In consideration of being permitted to participate in Sports Recovery Services at The Body Intuitive LLC, I hereby waive, release, and forever discharge The Body Intuitive LLC and its directors, officers, agents, employees, representatives, subcontractors, successors, and assignees from any and all responsibilities or liability from injuries or damages resulting from participation. I also release all of those mentioned from any responsibility or liability for any injury or damages to myself, including those caused by the negligent act of any of those mentioned or others acting on their behalf, in any way arising out of or connected with my participation in Sports Recovery Services. I knowingly, voluntarily, and expressly waive any claim I may have against The Body Intuitive and its owners, contractors, and employees for injuries or damages that I may sustain as a result of participating in Sports Recovery Services. 

Furthermore, I agree to irrevocably release from all liability and waive any claims that I have now or may hereafter have against The Body Intuitive LLC for any and all personal injury, death, property damage, or loss of any kind sustained as a result of my participation in services. To the maximum extent permitted by California law, I hereby release, waive, and discharge The Body Intuitive HQ, including its owners, officers, employees, contractors, agents, and representatives, from liability for injuries, damages, or losses arising out of or related to my participation in Sports Recovery Services, except where such release is prohibited by law. 

California Civil Code Section 1542 Waiver 

I acknowledge that I have read and understand Section 1542 of the California Civil Code, which provides: 

"A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." 

I expressly waive and relinquish any rights or benefits under Section 1542 and any similar law of any jurisdiction. This waiver applies to BOTH known and unknown claims arising from participation in Sports Recovery Services provided by The Body Intuitive, to the fullest extent permitted by law. 

3.4 ACKNOWLEDGEMENTS 

☐ I acknowledge and understand all Legal Disclaimers and release The Body Intuitive from liability as outlined above. 

☐ I have read and fully understand this Flow C Sports Recovery Service-Specific Waiver. 

☐ I understand that The Body Intuitive provides Sports Recovery Services (compression therapy and infrared sauna) as wellness support, NOT medical treatment or a substitute for professional healthcare. 

☐ I have reviewed the contraindications on the Compression Guide and Sauna Welcome Guide blogs and confirm I have no contraindications or have obtained medical clearance. 

☐ I voluntarily consent to receive Sports Recovery Services from The Body Intuitive. 

☐ I understand that it is MY responsibility to consult my physician before participating and to disclose all relevant health information and contraindications. 

☐ I acknowledge that I have also reviewed The Body Intuitive's Master Service Agreement (www.thebodyintuitive.com/masteragreement) and understand that both documents apply to my services. 

☐ I am at least 18 years old and have the legal authority to enter into this agreement. 

☐ I confirm all of the above and voluntarily agree to this Flow C Service-Specific Client Consent, Liability Waiver, and Service Agreement.
