PART A: Liability Waiver & Agreement

 

1. Introduction

Welcome to The Body Intuitive (“TBI,” "Company," "we," "us," or "our").

By participating in any online services, including courses, coaching, and/or the TBI Connects Membership (the “Services”), you agree to comply with and be bound by this Participant Agreement and Liability Waiver.

 

2. Definitions

  • “Services”: All online coaching, courses, and community access provided by us.

  • “Content”: All materials provided through our Services, such as text, graphics, videos, and other educational resources.

  • “Participant”: Any person who accesses or uses the Services.

 

3. Effective Date

This Agreement starts upon registration by the Participant in the Program and is enforceable starting on that registration date.

 

4. Services Provided

We offer online mobility services, personalized coaching sessions, online courses, and access to our community platform. These Services are designed to help users achieve personal and wellness goals.

 

5. Eligibility

You must be at least 18 years old to use our Services. If under 18, you may use our Services only with the involvement of a parent or guardian.

 

6. Payment and Refunds

Fees are as stated on our website upon purchase or enrollment and may be subject to change.

a. Cancellations:

  • If Member initiates cancellation: Membership may be self-canceled online through your Kajabi portal, which will terminate the subscription at the end of your current billing period. If you want to request a different cancellation date, or immediate cancellation, you may email us your request at [email protected]. Please allow 1-2 business days for a response.

  • If Payments are canceled: With the various payment processor options including Kajabi Payments, Stripe, and PayPal, canceled payments may revoke access to the Product(s) included with the purchased Offer.  

b. Refunds: Cancelled or expired memberships are not refunded.

 

7. Participant Responsibilities

  • Account Security: You are responsible for maintaining the confidentiality of your account login information.

  • Respectful Use: You agree to use our services lawfully and respectfully, following the Community Code of Conduct.

  • Prohibited Activities: Harassment, fraud, or other unlawful activities are strictly prohibited.

 

8. Health & Safety Disclaimer

Always consult a physician before starting any exercise or wellness program. These Services are not intended to provide medical advice or diagnoses. Enrollment in or purchase of any online course, membership, podcast, or self-study program does not establish a therapeutic, clinical, or client-provider relationship between you and The Body Intuitive, its instructors, or any affiliated practitioners. These offerings are educational and informational in nature and are not a substitute for individualized medical, psychological, or therapeutic care. Participation does not constitute being “under the care” of a licensed provider. If you require medical or psychological support, please consult a qualified healthcare professional.

 

9. Social Media & Communication Policy

  • Social Media: Connecting with your provider on social media may compromise confidentiality.

  • Electronic Communication: The confidentiality of communication via email or text cannot be guaranteed.

  • Membership and participation in online spaces are not protected under HIPAA regulations.

 

10. Disclaimer of Third-Party Content

The Company is not responsible for the accuracy or reliability of third-party content linked through the Services.

 

11. Liability Waiver and Release

By participating in The Body Intuitive’s offerings, you acknowledge and accept the inherent risks associated with somatic practices, especially for individuals with chronic pain, trauma histories, or injuries. You agree to participate at your own risk and to consult your healthcare provider before beginning any new movement, breathwork, or therapeutic practice. The Body Intuitive, its instructors, and affiliates disclaim all liability for injuries, losses, or damages resulting from participation in any course, membership, or self-study program. You agree to abide by all safety instructions and to discontinue participation if you experience pain, distress, or adverse effects.

The Body Intuitive is committed to trauma-informed, consent-based, and inclusive practices. All participants are expected to respect their own boundaries and those of others. Community guidelines prohibit harassment, discrimination, or any behavior that undermines psychological safety.

 


 

PART B: Copyright & Intellectual Property Policy

By enrolling in or purchasing any course, membership, podcast, or self-study program, you agree to adhere to this Copyright and Intellectual Property Policy and understand that violations may result in disciplinary action, removal from the program, or legal action.

  
1. Copyright & Ownership

1.a. All content provided through The Body Intuitive—including text, graphics, videos, audio, course materials, assessments, proprietary methodologies, and interactive features—is protected by U.S. and international copyright and intellectual property laws. These materials are the exclusive property of The Body Intuitive, its content creators, instructors, or third-party licensors. Unauthorized copying, distribution, replication, or use of these materials without explicit written permission is strictly prohibited. You may not use, reproduce, or distribute any Content without our explicit permission. Any use of the Services, including modification, transmission, presentation, distribution, republication, or other exploitation of the Services or of its content, whether in whole or in part, is prohibited without the prior written consent of the Provider.

1.b. Instructors contributing to The Body Intuitive retain copyright and intellectual property rights over their course materials and proprietary methodologies. Any use of instructor materials outside the course platform requires explicit written permission from the instructor.

 

2. Permitted Use and Your Usage Rights

2.a. Purchasers and enrolled students are granted a limited, non-exclusive, non-transferable license to access and use course materials for personal, non-commercial educational purposes only. This includes viewing and interacting with proprietary content, engaging in assignments, and participating in discussions within the course platform. Replicating, distributing, or reproducing proprietary content outside the provided platform is expressly forbidden. Certain materials will made available for download to students for their personal use. You may not reproduce, distribute, or create derivative works from our content without our express written permission. Access to course materials is granted for the duration specified at the time of purchase.

 

3. Prohibited Activities

You are strictly prohibited from:

  • Downloading, replicating, or capturing proprietary content for purposes other than personal study within the course platform.
  • Sharing, distributing, or making available any proprietary content to individuals not enrolled in the respective course or program.
  • Modifying, adapting, reverse-engineering, or creating derivative works based on proprietary content.
  • Using proprietary content for any commercial purpose without express written consent.
  • Hosting or posting proprietary content on external websites, forums, or platforms, whether for personal or commercial gain.

 

4. Copyright Infringement & DMCA Compliance

If you believe your copyrighted or proprietary work has been used in a way that constitutes infringement within The Body Intuitive’s platforms, please promptly notify us at [email protected] with:

  • Your contact information
  • A detailed description of the copyrighted or proprietary work
  • Identification of the specific course or location of the alleged infringement
  • A statement affirming your good-faith belief that the use is unauthorized
  • A statement, made under penalty of perjury, that the information is accurate and that you are the owner or authorized to act on the owner’s behalf

 

The Body Intuitive complies with the U.S. Digital Millennium Copyright Act (DMCA) and will promptly respond to valid takedown notices.

 

5. License Grant of User Content to the Company

By posting any Content via the Service and community membership forums, you expressly grant, and you represent and warrant that you have a right to grant, to the Company a royalty-free, sub-licensable, transferable, perpetual, irrevocable, non-exclusive, worldwide license to use, reproduce, modify, publish, list information regarding, edit, translate, distribute, publicly perform, publicly display, and make derivative works of all such User Content and your name, voice, and/or likeness as contained in your User Content, if applicable, in whole or in part, and in any form, media, or technology, whether now known or hereafter developed, for use in connection with the Services.

 

6. International Users

The Body Intuitive’s content is protected by copyright laws in the United States and internationally. Users outside the U.S. are responsible for complying with their local laws regarding intellectual property and online education.

 

7. Updates & Modifications

The Body Intuitive reserves the right to update or modify this Copyright and Intellectual Property Policy as needed. Any changes will be communicated to students and members through appropriate channels.

1. User Consent to Receive Communications
